MINUTES- 11-9-2011 SPECIAL MEETING
        A Special Meeting of the City Council was held in City Council Chambers on
Wednesday, November 9, 2011 at 6:45 P.M. for the purpose of taking action on the Massachusetts Health Insurance Reform Law.  Notice of this meeting was posted on November 3, 2011 at 6:19 P.M.


Absent were Councillors Ronan, Sargent and O’Keefe.

        
Council President Jerry L. Ryan presided.

Councillor Lovely assumed the Chair.

#685 – (#620) ACCEPT MASS. GENERAL LAW CHAPTER 32B, SECTION 21COMMITTEE REPORT

Councillor Ryan offered the following report for the Committee of the Whole to whom was referred the matter of acceptance of Massachusetts General Law Chapter 32B Section 21 Massachusetts Health Insurance Reform Law, which grants municipalities greater flexibility to modify their health insurance plans and manage rising health care costs.

The Rule of Necessity was read and invoked by the following:

Councillor Sosnowski – conflict due to he and his wife participate in the City’s Health Insurance Plan.

Councillor Furey – conflict due to he participates in the City’s Health Insurance  Plan.

Councillor Pelletier- conflict due to he participates in the City’s Health Insurance Plan.

Councillor Ryan – conflict due to his brothers & sisters participate in the City’s Health Insurance Plan.

Councillor McCarthy – conflict his wife participates in the City’s  Health Insurance Plan.

Councillor Pinto -  conflict due to he participates in the City’s Health Insurance Plan.


Councillor Ryan stated that there is an attached amended Order submitted in Committee by the City Solicitor with the recommended language by the State.


ORDERED: That the City of Salem elects to engage in the process to change Health Insurance Benefits under M.G.L. Chapter 32B, Sections 21 through 23.

Councillor Pelletier moved adoption of the amended Order. The Order was adopted by a roll call vote of 8 yeas, 0 nays, 3 absent. Councillors Sosnowski, Prevey, Pinto, Pelletier, McCarthy, Lovely, Furey and Ryan were recorded as voting in the affirmative. No one was recorded as voting in the negative. Councillors Sargent, Ronan and O’Keefe were recorded as absent.

Councillor Sosnowski moved for immediate reconsideration in the hopes it would not prevail. Reconsideration was denied.

On the motion of Councillor Sosnowski the meeting adjourned at 7:05 P.M.
